Welcome to GloballyHired (“we,” “us,” our,” “GloballyHired”), where professionalism, opportunity, and community converge. GloballyHired is a division of Scion Staffing, Inc. (“Scion”). GloballyHired is a recruiting platform connecting employers to talent for temporary and direct-hire positions (the “Services”).

At GloballyHired, we’re committed to creating an environment where professionals can connect, grow, and succeed. Our Services are designed to bridge geographical boundaries, enabling you to explore a world of opportunities.

Throughout this Term of Service, individuals utilizing our platform to search for employment opportunities, shall be referred to as ‘jobseekers,’ ‘talent,’ or ‘candidates,’ while entities or individuals seeking to hire talent, known as ’employer’, ‘employers,’ ‘clients,’ ’employer clients,’ or ‘companies’ shall be designated as such.

We encourage you to read these Terms carefully. Your commitment to following these Terms is required to ensure a positive experience for all members of our community. These Terms are not just legal requirements; they are the framework that sustains the integrity and fairness of our Platform. If you have any questions or need clarification on any aspect of these Terms, please don’t hesitate to reach out to us.

Acceptance of Terms

By accessing our Platform or using the Services, you agree to be bound by these Terms. These Terms constitute a legally binding agreement between you and us regarding your use of our Platform and related Services. Your acceptance of these Terms signifies your commitment to abide by our guidelines, policies, and applicable laws while using our Services and Platform.

If you do not agree with any part of these Terms, please refrain from using our Platform or Services.

Updates and Changes to Our Policy

These Terms may be updated or changed from time to time to reflect evolving practices and legal requirements. The “Last Updated” date at the top of this page indicates when the Policy was last revised. When changes are made, they will become effective as soon as we post the revised Terms on our website.

Your continued use of the Platform and our Services following any posted changes constitutes your acceptance of the revised Terms. Privacy Policy and Community Guidelines

All collection, processing and handling of user data will be governed by our Privacy Policy. By using our Platform and Services, you also agree to our data collection practices as outlined in our Privacy Policy and to abide by our Community Guidelines.

Not Intended for Children or Minors

Our Platform is not intended for individuals under the age of 18 years. If you are under 18, please refrain from accessing or using our Platform and Services.

User Registration

To fully access and utilize the features of GloballyHired, you may be required to register for an account. During the registration process, you agree to provide accurate, current, and complete information about yourself as prompted by the registration form. It is your responsibility to keep this information updated.

You also acknowledge the following:

  1. Account Security: You are solely responsible for maintaining the confidentiality and security of your account login credentials, including your username and password. Any actions taken on your account are your responsibility, whether authorized by you or not. You agree to notify us immediately if you suspect any unauthorized access or use of your account.
  2. Minors: As previously stated, our Platform is not intended for individuals under the age of 18. By registering, you confirm that you are at least 18 years old.
  3. Account Termination: We reserve the right to terminate or suspend your account at our discretion, without notice, for any violation of these Terms or for any other reason we deem appropriate, including violations of our Privacy Policy and Community Guidelines.
  4. User Consent: By registering and using our Platform, you consent to receive communications from us electronically, such as emails or notifications regarding your account, site updates, or other essential information. Our handling of such data will be governed by our Privacy Policy.
  5. Accuracy of Information: You are responsible for ensuring that all information provided during registration and throughout your use of the Platform and Services is accurate and up to date.

User Responsibilities

As a user of GloballyHired, you have certain responsibilities to maintain a positive and respectful online community. By using our Platform and Services, you agree to:

  1. Compliance with Policies: At all times adhere to these Terms, our Community Guidelines, and Privacy Policy.
  2. Accurate Information: Provide accurate, truthful, and up-to-date information that is not misleading, fraudulent, false, or illegal during registration and throughout your use of the Platform. Only provide information that is required or in support of using GloballyHired for its intended Services.
  3. Respectful Conduct: Interact with other users, our staff, and the Platform itself in a respectful, courteous, and professional manner. Harassment, hate speech, discrimination, or offensive behavior is strictly prohibited.
  4. Privacy and Security: Respect the privacy and security of other users. Do not share personal information without consent, attempt to access others’ accounts or data, or engage in any activity that compromises the security of the Platform.
  5. Content Responsibility: Take responsibility for any content you post or share on GloballyHired. Ensure it complies with our Terms and Community Guidelines and does not infringe on the rights of others.
  6. Compliance with Laws: Abide by all applicable laws and regulations when using our Platform. Do not engage in illegal activities, including but not limited to fraud, impersonation, or unauthorized access to computer systems or networks.
  7. Reporting Violations: Report any violations of these Terms or Community Guidelines promptly. Your vigilance helps maintain a safe and respectful environment for all users.
  8. Account Security: Safeguard your account credentials and notify us immediately if you suspect any unauthorized access or use of your account.
  9. Consent for Communication: Agree to receive communications from us electronically, including emails and notifications related to your account and Platform updates.
  10. Age Verification: Confirm that you are at least 18 years old when registering for an account, as our Platform is designed for adults.

By using GloballyHired, you acknowledge and accept these user responsibilities. Failure to adhere to these responsibilities may result in consequences, including account suspension or termination. We rely on your cooperation to create a positive and respectful community for all members. Thank you for being a responsible and valued part of our Platform.

User Prohibited Activities

Users of GloballyHired are expected to adhere to a high standard of professionalism and ethical conduct. The following activities are strictly prohibited on our Platform:

  1. Harassment and Discrimination: Engaging in any form of harassment, discrimination, or creating a hostile work environment based on race, gender, age, religion, nationality, disability, or any other protected characteristic.
  2. Illegal Content: Posting, sharing, or promoting any content that is illegal, including but not limited to hate speech, illegal drugs, firearms, or any form of illegal activity.
  3. Copyright and Intellectual Property (IP) Violation: Unauthorized use, reproduction, or distribution of copyrighted materials or intellectual property without proper authorization or license.
  4. False Information: Providing false or misleading information on profiles, job postings, or any other content on the Platform.
  5. Impersonation: Pretending to be another individual or entity, misrepresenting one’s identity, or using deceptive tactics to gain access to the Platform.
  6. Data Security Breaches: Unauthorized access, disclosure, or breach of sensitive data, including personal information of Jobseekers, employers, or associates.
  7. Spam and Unsolicited Messages: Sending excessive unsolicited messages, advertisements, or engaging in spammy behavior.
  8. Violations of Community Guidelines: Breaching specific Community Guidelines, policies, or Terms outlined by GloballyHired.
  9. Unethical Practices: Engaging in unethical practices that go against the principles of honesty, fairness, and professionalism.
  10. Privacy Violations: Breaching the privacy of Jobseekers, employers, or associates by sharing confidential or personal information without consent.
  11. Fraudulent Activity: Participating in fraudulent activities, including but not limited to scams, phishing, or other deceptive practices.
  12. Inadequate Payment Practices: Consistently making late payments, failing to compensate Jobseekers or associates as agreed upon, or engaging in unfair financial practices.
  13. More than One Account: Creating and using more than one account for fraudulent or deceptive purposes. Creating more than one jobseeker account for the same person or more than one employer account for the contact.
  14. Engaging in Hate Speech: Promoting or engaging in hate speech, promoting violence, or advocating for discrimination.
  15. Promoting Harmful Content: Sharing or promoting content that could be perceived as harmful, threatening, or offensive to others.
  16. Unapproved Use of Information: Unauthorized use of information obtained on the Platform for purposes not aligned with the Platform’s mission.
  17. Bypassing the Services: Using the Platform to facilitate hiring outside of the Platform, or bypassing our Services.
  18. Interference with Platform Operations: Attempting to disrupt or interfere with the normal operations of the Platform.
  19. Violence or Threats: Engaging in violent or threatening behavior towards other users.
  20. Misuse of Reviews and Ratings: Misusing the review and rating system to provide false or unfair feedback.
  21. Violation of Legal Requirements: Failure to comply with legal obligations, including labor laws, regulations, and industry-specific requirements.
  22. Failure to Resolve Disputes: Inability or unwillingness to resolve disputes or conflicts with other users fairly.
  23. Unapproved Solicitation: Soliciting Services or business opportunities on the Platform without proper authorization.
  24. Unauthorized Use of Third-party Accounts: Using third-party accounts or credentials without proper authorization.
  25. Any Other Unlawful or Inappropriate Conduct: Engaging in any other conduct that violates applicable laws, regulations, or the principles of professionalism and ethics.
  26. Communication, actions, or behavior that threaten the safety, reliability, credibility, or successful performance of our Services: These actions or behaviors can harm the experience of our users and/or threaten the success of our community.
  27. Working unauthorized hours or bypassing our platform: this includes billable time, overtime, projects, or assignments and/or bypassing GloballyHired’s timecard and payment system.

GloballyHired is committed to maintaining a safe and professional environment for all users. Violation of these prohibited activities may result in account suspension, removal, or legal action as deemed appropriate by GloballyHired.

We encourage all users to report any suspicious or inappropriate activity to our support team promptly. Your cooperation in maintaining a positive and ethical community is greatly appreciated.

Proprietary Content

At GloballyHired, we respect and value the intellectual property rights of all users and expect the same in return. You must respect the intellectual property laws protecting GloballyHired and the Services. Any content available through the Platform and Services, including software (whether downloadable or not), text, audio, video, pictures, graphics, music, sound clips, images, likenesses, personal information, and other works of authorship (collectively, “Proprietary Content”) is owned by Scion, GloballyHired or its licensors and protected by the intellectual property rights of GloballyHired or its affiliates and/or third-party licensors, where applicable.

You acknowledge and agree that certain content made available through the Platform and Services is the property of third-party licensors and, without prejudice to any and all other rights and remedies available, each such licensor has the right to directly enforce relevant provisions within these Terms against you.

Subject to your compliance with these Terms, GloballyHired grants you a limited, non-exclusive, non-assignable, non-sublicensable, revocable, license to use the Services as it is provided to you by GloballyHired solely for your personal use and only in a manner that complies with these Terms and all legal requirements that apply to you or your use of the Services.

GloballyHired may revoke this license at any time, in its sole discretion.

Trademarks

GloballyHired, the GloballyHired logo, Scion, the Scion logo and all other GloballyHired or Scion product or service marks are trademarks of Scion. All intellectual property, other trademarks, logos, images, product, and company names displayed or referred to on the Platform or the Services are the property of their respective owners. Nothing grants you any license or right to use, alter or remove or copy such material. Your misuse of the trademarks displayed on the Services is strictly prohibited. GloballyHired will enforce its trademark rights to the fullest extent of the law, including the seeking of criminal prosecution.

User Content

GloballyHired may enable you to post, upload, store, share, send, or display photos, images, video, data, text, comments, and other information and content (“User Content”) via the Platform and Services. You retain all rights to User Content that you post in connection with the Services. By making User Content available on or through the Services, you hereby grant to GloballyHired a non-exclusive, transferable, sublicensable, worldwide, royalty-free license to use, copy, modify, publicly display, publicly perform, reproduce, translate, create derivative works from, and distribute the User Content, in whole or in part, including your name, photo, avatar and likeness, in any media. The rights you grant us in this section are only for the limited purpose of offering and improving the Services and are subject to our obligations under our Privacy Policy.

You are responsible for User Content. You represent and warrant that you own the User Content or that you have all rights necessary to grant us a license to use the User Content as described in these Terms. Without limitation, you represent and warrant that your User Content is not of a type that you do not have a right to transmit under any law or under contractual or fiduciary relationships, such as proprietary and confidential information. You further agree not to submit User Content that identifies any individual (including by way or name, address or a still picture or video) under the age of 18. If you submit User Content that identifies any individual over the age of 18, you represent and warrant that you have that person’s consent to being identified in exactly that way in your User Content.

GloballyHired is under no obligation to restrict or monitor User Content in any way. GloballyHired does not regularly monitor the accuracy or reliability of user content. However, GloballyHired reserves the right to modify or remove any User Content at any time, or to restrict, suspend, or terminate your access to all or any part of the Services, particularly where User Content breaches these Terms, and we may do this with or without giving you any prior notice, unless otherwise prohibited by our Privacy Policy or applicable law.

We value open communication within our community. It’s essential to note that when you leave comments on our Platform, you agree and understand that all comments you make will be publicly visible on the Platform. This transparency fosters constructive dialogue and enhances the collaborative nature of our Platform. We encourage respectful and meaningful interactions within our community, and your understanding of this visibility is crucial in maintaining an environment conducive to professional and respectful discourse. Likewise, in cases where user comments are approved and published, your profile picture may be visible to the public alongside your comment. This ensures that the context of your comment is clear to other visitors.

Any opinions, reviews, advice, statements, services, offers, or other information or User Content expressed or made available by third parties, including other users, are those of the respective author(s) and not of GloballyHired. GloballyHired neither endorses nor is responsible for the accuracy or reliability of any opinion, advice, information, or statement made on the Services. We make no warranties or representations, express or implied, about User Content, including as to its legality or accuracy. We disclaim all liability in connection with User Content to the extent permitted by law.

Location Data in Images

Users acknowledge that when uploading images to GloballyHired, they should not include embedded location data (EXIF GPS). Uploading such images may expose the user to the risk of visitors extracting location data from their images on the Platform. In the event a user uploads images with embedded location data, they assume any associated risks. This includes the possibility that Platform visitors could potentially download and extract location data from the user’s images on the Platform.

For Employers

Employer Eligibility and Approval

To maintain the quality and integrity of our Services, we have established specific criteria and guidelines for employer accounts. All employers agree to adhere to these Terms governing eligibility. Please take a moment to review these policies carefully.

  1. Eligibility and Approval: At GloballyHired, we uphold standards to ensure the professionalism and quality of our Platform. Creating an employer account involves meeting defined criteria and adhering to certain guidelines. Employer users accessing our Platform and utilizing our Services hereby agree and acknowledge that GloballyHired will employ the following criteria for consideration in matters concerning eligibility, the approval process, and continuous assessment of Employer user eligibility:

a. Legitimate Businesses: To be eligible for an employer account on GloballyHired, businesses must be legitimate, possess verifiable business URLs, business name and entity type, locations, and employees, and have a verifiable history that demonstrates the potential for suitable hiring of Platform Jobseekers. Employers must exhibit the capacity to adhere to our policies and fulfill all financial obligations. As a Platform, we prioritize the inclusion of reputable and credible organizations with safe working environments within our community.

b. Legal Business Entities: Employers must be legally recognized business entities in their respective jurisdictions. This ensures that our Platform is exclusively used by organizations operating within the bounds of the law. Employers must use their entity’s legal name or legal DBA while using our Platform.

c. Good Credit History: Maintaining a positive credit history is an important indicator of financial stability and responsibility. Employers are encouraged to have a favorable credit history to be eligible for an account. By registering, Employers agree for GloballyHired and our EOR Partner to evaluate their creditworthiness, including a credit check, as part of the evaluation process. Employers must show a history of successfully paying their debts and fiscal responsibility for their partners.

d. Positive and Safe Environment: In the evaluation process, we assess whether the employer provides a positive, hate-free, and safe environment for Jobseekers. We may review public reviews related to the company’s work environment on platforms such as Glassdoor, Google, or other publicly available sources.

e. Other Factors: In addition to the criteria outlined above, we consider various factors, including the compatibility of the employer and their job listings with our Platform; compatibility of the employers services/products to be a match to hire professional talent; completeness of the employer profile including typos/spelling and formatting; alignment with our mission and values; workers’ compensation classifications; employer industry; employer location; Jobseeker feedback and complaints; the entity’s history; legal considerations; the employers ability to adhere to our terms and policies; and any other publicly available information that demonstrates the employer’s suitability for our Platform community. Our evaluation process strictly adheres to all applicable legal regulations. 

  1. Employer Approval Process: Every employer account on GloballyHired undergoes a comprehensive evaluation and approval process. This includes a detailed review of the business details, products/services, website, and contact information and the information provided during registration. We also assess how well the employer’s services and values align with GloballyHired’s standards for professional hiring, ensuring a strong fit for our platform.
  2. Discretionary Evaluation: GloballyHired reserves the right to exercise discretion in approving or denying/rejecting employer accounts for any reason.
  3. Ongoing Evaluation: Our commitment to maintaining a professional and safe community means that we continuously assess employer accounts during their use. We may consider various factors, including public reviews and feedback from our Jobseekers and associates, to ensure alignment with our values. Our goal is to create a diverse and professional community, and we conduct ongoing evaluations on a case-by-case basis to ensure the best possible experience for our users.
  4. Right to Stop Servicing an Employer: GloballyHired reserves the right to cease servicing an employer at any time and for any reason deemed necessary. This includes non or late payments, Jobseeker complaints, allegations of hostile work environments or harassment, or any allegation that violates our Terms, Community Guidelines, Privacy Policy, EOR Partner policies, or other GloballyHired policies. We take such actions to uphold the quality and integrity of our Platform and to ensure a positive experience for all users.

If you have any questions regarding the approval process, eligibility criteria, ongoing evaluation, or our right to stop servicing an employer, please do not hesitate to contact us. We greatly appreciate your understanding and cooperation in maintaining the quality of our Platform.

Employer Responsibilities

Employers on GloballyHired commit to upholding fair hiring practices and ensuring a safe and inclusive working environment for GloballyHired associates. By using our Platform, employers also agree to the following:

  1. Non-Hostile and Safe Work Environment: Employers undertake not to engage in unfair hiring practices or create hostile or unsafe work environments for associates found through GloballyHired. In the event of any lawsuits, legal actions, or allegations arising from unacceptable working conditions, employers agree to indemnify and hold harmless GloballyHired.
  2. Safety and Liability: Employers accept the responsibility of ensuring that their working environments, whether online or in-person, maintain a safe and secure atmosphere. This responsibility extends to all aspects of their business, including their company, premises, staff, and any onsite visitors or vendors.
  3. Follow Local, State, Federal, Country, and International Laws: Employers are required to comply with all applicable local, state, federal, country, and international laws, regulations, and standards in their hiring practices and work environments. This includes adhering to labor laws, anti-discrimination laws, health and safety regulations, and addressing issues such as wrongful termination, harassment, discrimination (based on race, gender, age, religion, disability, etc.), retaliation against employees who report violations or exercise their legal rights, and other relevant legal requirements in both the employer’s location and the areas where their remote staff live and work. Employers agree to take full responsibility for ensuring their practices meet or exceed the legal standards set forth by all relevant jurisdictions. Though employers are not the official Employer of Record (EOR) for the temporary, interim, and fractional staff they hire from GloballyHired, they and their staff agree not to direct or oversee these employees in any way that would result in breaking any law or causing harm to the talent hired via our platform. Employers assume all liability in the rare event of any legal infractions or harm arising from such actions.

At GloballyHired, we are committed to fostering an environment where all parties can thrive professionally and feel secure. Employers’ adherence to these responsibilities is integral to achieving this goal and ensuring a positive experience for everyone involved.

Employer Account Removal

GloballyHired reserves the right, without liability, to modify, discontinue, reject, or revoke an employer’s access to the Services or Platform at any time to maintain the integrity and professionalism of our Services and Platform.

Employer Account removal may be initiated based on various factors, including but not limited to:

  1. Feedback and Reviews: Feedback and reviews about the employer posted by our community members, including Jobseekers and associates.
  2. Employer Information: Information regarding the employer’s business and operations, including the content and credibility of the employer’s website, the legitimacy and location of the employer’s business, the duration for which the business has been operational, the nature and purpose of the employer’s business, and the financial history and creditworthiness of the employer.
  3. Mission and Values: The alignment of the employer’s values with those of GloballyHired.
  4. Professional Behavior: Interactions and conduct of the employer towards GloballyHired employees and associates.
  5. Suspicion or Evidence of Illegal Activity: Any indications or evidence of illegal conduct.
  6. Content Violations: Instances where content posted by the employer violates our Terms, Privacy Policy or Community Guidelines.
  7. False or Misleading Statements: Providing false or misleading information to our staff or on our Platform.
  8. Unauthorized Use: Unauthorized or improper use of the Services.
  9. Complaints and Allegations: Complaints, allegations, or charges related to harassment, unsafe work environments, discrimination, abuse, fraud, or unfair business practices.
  10. Unapproved Creation of More than One Account: Creating more than one account without proper authorization.
  11. Potential Legal Disputes: Potential legal disputes that may adversely affect GloballyHired or its associates.
  12. Financial Obligations: Failure to fulfill financial obligations or payments.
  13. Incomplete or Inaccurate Information: Providing incomplete or inaccurate information during the registration or account management process.
  14. Incorrect Account Type: Intentionally selecting an inappropriate account type for registration.
  15. Lack of Communication: Failure to effectively communicate with our staff regarding safety, work assignments, human resources, administrative, legal, or financial matters related to the use of GloballyHired by employers.
  16. Use of Hate Speech and Harassment: Engaging in hate speech, any forms of harassment, or creating hostile work environments.
  17. Privacy Violations: Breaching the privacy of Jobseekers or associates.
  18. Spam and Unsolicited Messages: Sending excessive unsolicited messages or engaging in spammy behavior.
  19. Failure to Comply with Legal Requirements: Failure to comply with legal obligations or regulations relevant to the employer’s industry.
  20. Failure to Resolve Disputes: Inability or unwillingness to resolve disputes or conflicts with Jobseekers or associates fairly.
  21. Misuse of Job Postings: Posting misleading or deceptive job listings.
  22. Discrimination: Engaging in discriminatory practices against Jobseekers or associates based on protected characteristics.
  23. Inadequate Payment Practices: Consistently making late payments or failing to compensate Jobseekers or associates as agreed upon.
  24. Impersonation: Pretending to be another individual or entity, or misrepresenting one’s identity.
  25. Lack of Transparency: Failing to provide requested information or being uncooperative in addressing inquiries from GloballyHired staff.
  26. Engaging in Unethical Practices: Any unethical practices or actions that go against the principles of honesty, fairness, and professionalism.
  27. Data Security Breaches: Unauthorized access, disclosure, or breach of sensitive data, including personal information of Jobseekers or associates.
  28. Communication, actions, or behavior that threaten the safety, reliability, credibility, or successful performance of our Services: These actions or behaviors can harm the experience of our users and/or threaten the success of our community.
  29. Identity Theft: Unauthorized use of another individual’s identity or information for fraudulent purposes.
  30. Assisting Entities to Hire Outside the Platform: Using the Platform to facilitate hiring outside of the Platform, bypassing our Services.
  31. Unauthorized Use of Information: Unauthorized access, theft, or misuse of GloballyHired information not intended for purposes aligned with the Platform’s mission.
  32. Rude or Unprofessional Behavior, Reviews, or Complaints: Engaging in disrespectful, unprofessional, or offensive behavior, including rude interactions, reviews, or complaints.
  33. Copyright or Intellectual Property (IP) Violation or Complaints: Violation or complaints of copyright or intellectual property rights, including unauthorized use or reproduction of copyrighted materials or intellectual property.
  34. Other Factors: In addition to the criteria outlined above, we consider various factors, including the compatibility of the employer and their job listings with our Platform; compatibility of the employers services/products to be a match to hire professional talent; completeness of the employer profile including typos/spelling and formatting; workers’ compensation classifications; employer industry; employer location; Jobseeker feedback and complaints; the entity’s history; legal considerations; the employers ability to adhere to our terms and policies; and any other publicly available information that demonstrates the employer’s suitability for our Platform community. Our evaluation process strictly adheres to all applicable legal regulations. 

We understand that each business is unique, and our goal is to create a diverse and professional community. As such, we may assess eligibility and conduct ongoing evaluations on a case-by-case basis to ensure the best possible experience for our users.

Employer Reviews

GloballyHired operates as a social review-based on-demand employment Platform. By utilizing GloballyHired’s Services or signing up as an employer, you acknowledge and agree to the following:

  1. Review by Hired Staff: Employers agree that they may be subject to reviews by Jobseekers they hire through GloballyHired. These reviews are part of our commitment to transparency and ensuring a fair and reliable Platform.
  2. Reciprocal Reviews: Employers also have the opportunity to review the Jobseekers they hire via GloballyHired. This two-way feedback system promotes accountability and trust within our community.
  3. Jobseeker Eligibility and Approval

To maintain the quality and integrity of our Services, we have established specific criteria and guidelines for jobseeker accounts. All jobseekers agree to adhere to these Terms governing eligibility. Please take a moment to review these policies carefully.

Eligibility and Approval: At GloballyHired, we uphold standards to ensure the professionalism and quality of our Platform. Creating a jobseeker account involves meeting defined criteria and adhering to certain guidelines. Jobseeker users accessing our Platform and utilizing our Services hereby agree and acknowledge that GloballyHired will employ the following criteria for consideration in matters concerning eligibility, the approval process, and continuous assessment of Jobseeker user eligibility:

  1. Legitimate Individual: To be eligible for a jobseeker account on GloballyHired, jobseekers must be legitimate, possess verifiable identity information, not be duplicates, provide their legal name and contact information including their tax address, and must be seeking a professional position related to the services of GloballyHired.  
  2. Possess Active Work Authorization and Domiciled in the US: Jobseekers must be authorized to work, and their legal tax address must be in the US. As our platform scales and grows in the future, other countries may also be added. Jobseekers do not have to be US citizens to be considered for work on our platform, nor do we consider national origin. We comply with all applicable laws in our evaluation process.
  3. Agree to Terms and Guidelines: Jobseekers must exhibit the capacity to adhere to our policies within our Terms of Service and Community Guidelines
  4. Complete Talent Profile: All possible sections must be fully completed and/or as requested by GloballyHired staff.
  5. Typos and Error-Free: Profiles must be free from typos and errors, including full sentences, using sentence case, and being free from misspellings and formatting errors. 
  6. Demonstrable Prior Professional Work Experience: Jobseekers must have prior demonstrable professional work experience (paid, internship or volunteer) that aligns with the services of GloballyHired. To be eligible, Talent must have a minimum of 12 months of work experience, with at least 6 months dedicated to handling responsibilities and tasks directly related to the desired job title. While Talent may not have held the exact title in the past, their experience should clearly demonstrate at least 6 months of highly relevant work in the related field/title of interest.
  7. Written profile language: Bilingual and multilingual Jobseekers are very welcome to join GloballyHired but profiles must be written in English. Additional profile options may be possible as we scale and grow the services to countries outside of the US.
  8. Other Factors: In addition to the criteria outlined above, we consider various relevant factors, including the compatibility of the jobseeker and their profile with the jobs and services on our Platform, the ability to follow instructions throughout the signup process, professionalism and communication with GloballyHired staff, the suitability of the provided content for a professional job platform, workers’ compensation classifications, jobseeker industry, jobseeker location, and legal considerations. Our evaluation process strictly adheres to all applicable legal regulations, and we do not consider any protected class information or physical characteristics. 

Jobseeker Approval Process: All jobseeker accounts undergo a human-based review and approval process conducted by GloballyHired. This process includes reviewing the information provided during registration, such as jobseeker details, experience, introductory information, headline, contact information and all submitted information.

Discretionary Evaluation: GloballyHired reserves the right to exercise discretion in approving or denying jobseeker accounts for any reason. GloballyHired also reserves the right to request additional information about jobseeker work history and related profile information, as well as the right to request changes to the provided information.

Ongoing Evaluation: Our commitment to maintaining a professional and safe community means that we continuously assess jobseeker accounts during their use. We may consider various factors, including public reviews and feedback from our employers and staff, to ensure alignment with our policies. Our goal is to create a diverse and professional community, and we conduct ongoing evaluations, as needed, on a case-by-case basis to ensure the best possible experience for our users.

Right to Stop Servicing a Jobseeker: GloballyHired reserves the right to cease servicing a jobseeker (or reject their profile) at any time and for any reason deemed necessary. This includes employer complaints, allegations of hostile actions or behavior or harassment, or any allegation that violates our Terms of Service, Community Guidelines, Privacy Policy, EOR Partner policies, or other GloballyHired policies. We take such actions to uphold the quality and integrity of our Platform and to ensure a positive experience for all users.

If you have any questions regarding the approval process, eligibility criteria, ongoing evaluation, or our right to stop servicing a jobseeker, please do not hesitate to contact us. We greatly appreciate your understanding and cooperation in maintaining the quality of our Platform.

Agreement to Employer Reviews and Liability Release

At GloballyHired, we prioritize transparency and accountability, and this review process is integral to fostering a fair and reliable job-seeking environment for both jobseekers and employers. Your use of our Platform and Services implies your agreement to participate in this feedback system, which contributes to maintaining the quality of interactions and outcomes within our Platform.

By using GloballyHired’s Platform as a jobseeker (“Jobseeker”), you acknowledge and agree to actively participate in the employer feedback and review process. This process entails allowing employers to provide public feedback on your work, the employer’s overall satisfaction, and the employer’s experience throughout your collaboration. These reviews can vary in nature, encompassing both positive and negative feedback, and are represented through a star rating system ranging from zero to five stars.

As a Jobseeker, you understand and accept the responsibility for the reviews you receive, which are an inherent part of using a review-based job Platform like GloballyHired. You also recognize that these reviews could impact your reputation, income, and potentially your ability to be hired by other employers on the site. Additionally, you are aware that these reviews are public in nature and may be accessible on the internet. Therefore, you voluntarily choose to utilize GloballyHired’s Services, fully aware of the Platform’s review-based nature and the public visibility of these reviews.

In consideration of your voluntary participation, you hereby release GloballyHired from any and all liability associated with claims related to harm to your reputation, income loss, or any other civil lawsuit arising from the reviews you receive after completing work, up to the maximum extent permitted by applicable law. This release of liability encompasses all aspects of the review process and is a fundamental part of your engagement with our platform.

Jobseekers may dispute/report reviews that they have received from employers that they believe violate GloballyHired’s Terms of Service and/or Community Guidelines. Jobseekers can dispute a review via the ‘Reviews received’ tab within Completed jobs.

At GloballyHired, we are dedicated to maintaining a fair and transparent job-seeking environment for Jobseekers like you. We greatly appreciate your understanding and cooperation in this regard.

GloballyHired Review Moderation Policy
Our review moderation policy is designed to ensure that all reviews shared on our platform adhere to our Terms of Service and Community Guidelines. This policy outlines how we review user-submitted content and the criteria for its removal.

User Reports: We encourage our community to report reviews or content that they believe violate our Terms of Service or Community Guidelines. These reports are prioritized and reviewed by our team for appropriate action.

Review Evaluation: Each reported or flagged review is evaluated on a case-by-case basis. Our team assesses the content against our Terms of Service or Community Guidelines to determine if a violation has occurred.

Criteria for Content Removal

Content may be removed from GloballyHired if it:
• Violates our Community Guidelines or Terms of Service.
• Contains hate speech, discriminatory remarks, threats, or personal attacks against others.
• Includes explicit or implicit endorsements of illegal activities.
• Is found to be fraudulent, deceptive, or not relevant to GloballyHired’s services.
• Contains spam, malicious links, or is intended to harass or spam individuals or other businesses.
• Violates the privacy of individuals, including sharing private or confidential information without consent.

Decision Authority
The decision to remove or take action against any review or content is at the sole discretion of GloballyHired. While we aim to ensure fairness and transparency in our review process, we reserve the right to remove any content that we determine violates our Terms of Service or Community Guidelines.

Appeals Process
If your content has been removed or moderated, and you believe this action was taken in error, you may appeal the decision by contacting our support team. Please provide a clear explanation of your reasoning along with any evidence you wish to present in support of your appeal. Our team will review your submission and respond in a timely manner.

Fostering Safe and Respectful Work Environments

  2. Report Unhealthy Environments: If you encounter a work environment that feels unsafe, toxic, or discriminatory, we encourage you to promptly report it to our dedicated support team. Your well-being is our top priority, and we are here to provide assistance and support.
  3. Zero Tolerance for Harassment: We maintain a zero-tolerance stance towards any form of harassment. If you experience or witness harassment in any capacity, please report it without hesitation. We are committed to taking appropriate actions to address and resolve such issues.

Account Access Termination. All users consent to the following Terms regarding termination of account access:

  1. Removal, Limitation, or Termination: Users acknowledge and agree that GloballyHired reserves the right to remove, limit, block, stop, withhold, or terminate access to our site at any time and for any legitimate business reason. Use of GloballyHired is a privilege, not a right.
  2. Non-Disclosure of Reasons: GloballyHired is not obligated to disclose the specific reasons for the removal, limitation, blocking, stopping, withholding, or termination of access unless required by applicable law. Such actions may be taken for reasons including but not limited to non-payment of invoices, low rating scores, inappropriate conduct, misleading or illegal activity, and more.
  3. Release of Liability: By using GloballyHired, all users agree to release GloballyHired from any and all liability or responsibility stemming from the removal, limitation, blocking, stopping, withholding, or termination of their access. this release encompasses any reason deemed appropriate by GloballyHired, including but not limited to low rating scores or negative employer feedback regarding their work.

General Employment Related Terms

  1. Profile Listing: All users of GloballyHired acknowledge and agree to the following Terms regarding profile listings/Users understand and accept that the decision on which Jobseekers, employers, or any users are listed and active on the site is entirely at the sole discretion of GloballyHired. GloballyHired reserves the right to determine the criteria for listing users on the Platform at all times. Users acknowledge that the criteria for profile listings on GloballyHired shall be solely determined by GloballyHired. GloballyHired will never deny approval of any profile based on any protected class, including but not limited to race, color, religion, sex, sexual orientation, gender identity, national origin, age, disability, or any other characteristic protected by applicable law.
  2. References and Checking References:

a. For Jobseekers

i. Voluntary Reference Sharing: Jobseekers voluntarily choose to provide reference information for potential employers to review.

ii. Reference Contact Permission: By sharing reference information, Jobseekers grant GloballyHired permission to contact the provided references for verification.

iii. Publication of Reference Scores: Jobseekers acknowledge and agree that the results of the reference checks, including reference scores, will be listed on the Platform. These scores will be in addition to any project ratings they have received.

iv. Access by Registered Employers: Reference scores obtained through the reference checking process will be accessible to all registered employers on demand via the Platform. Jobseekers voluntarily agree to make this information available on the Platform.

v. Protection of Reference Contact Information: GloballyHired will not make public the contact information or last names of any references submitted to our Platform, unless required by law. Only the scores from the reference checks will be viewable on the Platform.

vi. Immediate Reference Sharing: Jobseekers agree to provide references immediately upon signup or as soon as the reference information is entered into the GloballyHired system.

vii. Reference Information Accuracy: Jobseekers confirm that the reference information they provide, including job details, contacts, and contact information, is accurate and not false, fake, misleading, fraudulent, illegal, incorrect, coerced, or manipulated in any way.

viii. Consequences of False Information: Users providing reference information determined to be false, fake, misleading, fraudulent, illegal, incorrect, coerced, or manipulated in any way will not be eligible for active work through GloballyHired.

ix. GloballyHired’s Discretion: Users acknowledge that GloballyHired reserves the right, in its sole discretion, to determine what reference information or reference results are considered false, fake, misleading, fraudulent, illegal, incorrect, coerced, or manipulated in any way.

X. RELEASE OF LIABILITY: ALL USERS AGREE TO RELEASE GLOBALLYHIRED FROM ANY AND ALL LIABILITY STEMMING FROM THE RESULTS OF REFERENCE CHECKS, OR ANY ENSUING CONSEQUENCES THAT MAY ARISE AS A RESULT OF THIS INFORMATION OR PROCESS.

b. For Employers

i. Reference Information Source: Employers acknowledge that the references listed on a User’s profile are provided by the Jobseeker, and as such, the Jobseeker selects whom they include as references.

ii. Accuracy of Reference Information: Employers understand that GloballyHired, as a job Platform, cannot guarantee or verify the truth and accuracy of the information or scores in any reference report. Employers agree to assume the responsibility and liability for relying on this reference information and double-checking the validity of the information therein.

iii. Candidate Screening Responsibility: Employers agree to conduct thorough candidate screenings to ensure that candidates are reliable and suitable for the roles they are seeking to fill. This may include phone interviews, video or in-person interviews, candidate assessments, and other screening methods to validate the accuracy of the candidate’s profile.

IV. Release of Liability: Employers understand and agree to release GloballyHired from any liability related to hiring a candidate from the platform whose background was inaccurately represented in terms of experience, title, skills, or any other aspect. Employers acknowledge that GloballyHired provides reference checking, project ratings, and background checking services that can be utilized in conjunction with other screening methods to ensure candidate quality and validity.

v. Non-Discrimination: Employers commit to not use any reference information or any other criteria to deny job offers or employment based on any protected class, including but not limited to race, color, religion, sex, sexual orientation, gender identity, national origin, age, disability, or any other characteristic protected by applicable law. This addition underscores the responsibility and liability of Employers regarding reference information and their commitment to verifying its accuracy when making hiring decisions.

  1. Background Checks for Jobseekers

a. Background Checks as Needed: All Jobseeker on GloballyHired acknowledge that background checks may be conducted if deemed necessary for a specific employment role after receiving a formal job offer.

b. Contingent on Employer Requirements: Jobseekers understand that any potential employment offers they receive are contingent upon successful completion of a background check with favorable results. Background checks include federal, state, and local criminal history checks, social security verification, and in some cases can also include credit checks, educational verifications, drug screening, certification checks, or other relevant checks required to work at the employer.

c. Legal Limits Adherence: All background checks will be conducted within the bounds of local, state, and federal legal limits.

D. RELEASE OF LIABILITY: ALL USERS, INCLUDING JOBSEEKERS, AGREE TO RELEASE GLOBALLYHIRED FROM ANY AND ALL LIABILITY STEMMING FROM THE RESULTS OF BACKGROUND CHECKS, DRUG SCREENS, OR ANY ENSUING CONSEQUENCES THAT MAY ARISE AS A RESULT OF THIS INFORMATION.

e. Sharing of Background Check Information: Jobseekers further agree that any information obtained through the background check may be shared with the prospective employer (including their hiring managers and administrators) who requested the background information from the Jobseeker.

f. Badge for Successfully Background Checked Users: Jobseekers agree that once a successful background check has been completed (after an offer has been made), a badge can be listed on the site indicating that they have already undergone a background check visible to the employer/company that requested the check. However, the specific results of past background checks cannot be shared outside of the requesting employer company. Each employer company must conduct their own background check to access this information. Thus, the Jobseekers will always be contacted first as part of our process.

G. Background Check Disclaimer: Employers and users agree not to hold GloballyHired responsible or liable for any information discovered, disclosed, transmitted, or made available online, in person, or electronically as part of background checks or reference checks. while GloballyHired provides this information, it does not guarantee its absolute accuracy. Errors, omissions, false information, fraud, or missing details, including multiple aliases, may impact the accuracy of background or reference checks. GloballyHired conducts background checks on individuals’ legal names but does not guarantee the review and checking of candidate aliases. The responsibility for checking aliases lies with the description of GloballyHired. Employers agree not to hold GloballyHired responsible or liable for any hiring decisions, consequences, or actions resulting from their use, review, or knowledge of background check or reference check information.

  1. Job Offers and At-Will Employment. By using GloballyHired, all users acknowledge and agree to the following Terms and conditions regarding job offers and at-will employment:

a. No Guaranteed Employment Duration: All job offers and employment opportunities provided through GloballyHired are not guarantees of employment for any specific length or duration. Regardless of any circumstances, including issues related to GloballyHired, its Platform, employer clients, EOR partner, or Services, users release GloballyHired from any liability if a job assignment or offer does not materialize or is terminated. Job offers do not assure continued employment.

b. At-Will Employment: Employment obtained through GloballyHired is at-will. Users acknowledge that no verbal or written conversations, agreements, or other communication can alter the at-will nature of employment gained through GloballyHired.

c. Release of Liability: Users further agree to release GloballyHired and its EOR Partner from any liability, regardless of fault, if a job or job offer does not proceed as expected. This includes situations where a job does not commence, prematurely ends, is not the duration expected, placed on pause/hold, where the candidate is terminated, project ends, if the job responsibilities or title is changed, restructured, pay rate changes, working hours change, onsite or remote requirements change, or position is different than the hired jobseeker anticipated. Users also agree not to hold GloballyHired responsible or liable if they are restricted, removed, or limited from using GloballyHired due to actions taken by our staff, technology, or systems.

d. Voluntary Consideration for Employment: Users acknowledge that consideration for employment via GloballyHired is entirely voluntary and understand and agree that if hired the employment would be at-will and via our EOR Partner.

  1. Employer of Record Disclaimer. GloballyHired is not an employer of record for the staff placements it facilities via its platform and services. All users agree and understand that their official Employer of Record (EOR) for work via GloballyHired (either on a temporary, project or interim basis) is though our official EOR Partner. All users agree and understand that their official employer of record (EOR) for work via GloballyHired (either on a temporary, project or interim basis) is though our official EOR Partner. All Jobseeker users agree and understand that their official Employer of Record if hired via our Platform(the name of the entity that will be officially hiring you and whose name will be on your checks) will be another company and not GloballyHired. All users agree and understand that our Employer of Record partner is solely responsible for:

a. Being The Official Employer for All Staff Hired: The EOR serves as the official employer for the Jobseeker for all temporary, project or interim assignments. This means they handle all legal and administrative aspects of the employment relationship, including compliance with labor laws and regulations.

b. Hiring the Candidate: The EOR is responsible for hiring the placed Jobseeker on behalf of the GloballyHired employer client company. The EOR oversees the hiring process, which may include prior to the start date conducting further screening, background checks, drug screens, and onboarding the Jobseeker.

c. Managing Time: Our EOR Partner manages the Jobseeker’s tracked hours worked, and ensures that the Jobseeker follows the EOR guidelines, policies and applicable laws or regulations.

d. Paying For Time: Our EOR Partner is responsible for process payroll for the Jobseeker. This includes calculating and disbursing their wages or salary, as well as handling deductions for taxes and benefits. They also can answer questions as to payroll, deductions and other related tax, payroll, legal or employer of record questions.

e. Issuing W-2s: At the end of the year, the EOR Partner is responsible for issuing W-2 forms to the Jobseekers they employ. These forms detail the earnings and tax withholdings, which are essential for filing income tax returns.

f. Benefits Administration: Our EOR Partner offers benefits packages, including health insurance, retirement plans, and other perks. They manage enrollment, administer benefits, and handle related inquiries.

g. Employee Relations: Our EOR Partner serves as a point of contact for Jobseekers to address workplace concerns, disputes, or HR-related issues. They provide guidance on company policies and procedures.

h. Compliance and Legal Support: Our EOR Partner ensures compliance with labor laws and regulations is a critical responsibility. Our EOR Partner handles all legal documentation relating to employment.

i. Training and Development: Our EOR Partner provides any training(s) that are required by local, state, or federal law.

j. Time and Attendance Tracking: Our EOR Partner manages all time and attendance records, including days hours worked and paid sick leave (if applicable and required for the role and location).

k. Payroll Taxes: Our EOR Partner is responsible for withholding and remitting payroll taxes to government authorities. This includes federal and state income tax, Social Security, and Medicare contributions.

l. Unemployment Claims: Our EOR Partner is responsible for assisting with unemployment claims and related paperwork.

m. Record Keeping: Our EOR Partner is responsible for maintaining accurate records of Jobseekers’ employment history, pay stubs, and related employment documents.

n. Workers’ Compensation: Our EOR Partner manages all workers’ compensation claims.

o. Termination and Exit Processes: When a Jobseeker’s assignment or contract ends, our EOR Partner handles the termination process, including final paychecks and any necessary paperwork.

Third Party Websites

Our Services may contain links to other applications, websites, or online services (collectively, “Third Party Services”), owned and operated by third parties over which GloballyHired has no ownership or control.

You acknowledge and agree that the Third-Party Services may have different privacy policies, terms of use, user guides, and/or business practices (collectively, “Third-Party Rules”) than GloballyHired, and that your use of such Third-Party Services is governed exclusively by the respective Third-Party Rules. We may provide links to Third-Party Sites to you as a convenience, and we do not verify, make any representations, or take responsibility for such Third-Party Services, including, without limitation, the truthfulness, accuracy, quality, or completeness of the content, application, links displayed, the quality of the services, and/or any other activities conducted on or through such Third-Party Services.

If you do not understand or do not agree to the terms of a third-party service provider’s privacy policy or terms of use, you should not use the related third-party services. we will not, under any circumstances, be responsible or liable for any of your information collected or used by third-party services.

Availability of Platform and Services

Although we aim to offer you the best service possible, we make no promise that the Platform and Services will meet your requirements and we cannot guarantee that the Platform and Services will be fault-free. If a fault occurs in the Platform or Services, please report it to us using the link in the Contact Us section below. If the need arises, we may suspend access to the Platform and Services while we address the fault. We will not be liable to you if the Platform and/or Services are unavailable for any period of time. Your access to the Platform and Services may be occasionally restricted to allow for repairs, or maintenance.

We urge you to keep backup copies of your User Content, if any, that you maintain on or use with the Platform and Services. Faulty operation of devices, incorrect or overly slow transmission of data by the internet provider, and/or any personal damage that occurs due to information submitted by you not being received by us or not being received promptly or not being considered, as a consequence of technical faults with our software or hardware (whether or not they are within or outside of our control).
  2. Any loss or damage due to viruses or other malicious software that may infect your device, computer equipment, software, data, or other property caused by you accessing, using, or downloading from the Platform and Services, or from transmissions via emails or attachments received from us.
  3. Any use of Third-Party Services.

Limitation on Liability

The following limitations on liability are in addition to and not in limitation of any other limitations or releases of liability set forth in these terms.

To the maximum extent permitted by law, in no event shall GloballyHired or its affiliates, suppliers, employer clients, talent, or licensors be liable for any direct, indirect, special, incidental, consequential, exemplary or punitive damages, lost profits, lost revenue, loss of data, loss of privacy, loss of goodwill or any other losses arising from, or directly or indirectly related to, the use of, or the inability to use, the platform and services or the content, materials and functions related thereto, even if we have been advised of the possibility of such damages and even in the event of fault, tort (including negligence) or strict or product liability. In no event shall GloballyHired be liable for any user content or for any third-party services. In no event shall the total aggregate liability of GloballyHired to you for all damages, losses, and causes of action (whether in contract or tort, including, but not limited to, negligence or otherwise) arising from these terms or your use of the platform and services exceed, in the aggregate, the amount, if any, paid by you to GloballyHired for your use of the platform or services during the previous 12 months or, if greater, $100.

Some jurisdictions do not allow the exclusion of certain warranties or the exclusion or limitation of liability for consequential or incidental damages, so if you are a resident of any of those jurisdictions, the limitations above may not apply to you.

Indemnification

You agree to hold GloballyHired, and its subsidiaries, affiliates, officers, directors, employees, agents, attorneys, and suppliers, and each of their respective successors and assigns (collectively, the “Indemnified Persons”), harmless from, and indemnify them for, all damages, costs, expenses and other liabilities, including reasonable attorneys’ fees and expenses, relating to any claim arising out of or related to: (i) your violation of these Terms and any applicable law or the rights of another person or party; (ii) any dispute you have with any User of the Platform and/or Services; (iii) GloballyHired’s resolution (if any) of any dispute you have with any User of the Platform and/or Services; or (iv) your User Content.

If you are a California resident, you hereby waive California Civil Code §1542, which says: “A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release, and that if known by him or her would have materially affected his settlement with the debtor or released party.” This release includes the criminal acts of others. If you are not a California resident, you waive your rights under any statute or common law principle similar to Section 1542 that governs your rights in the jurisdiction of your residence.

Miscellaneous

Assignment

GloballyHired may transfer its rights and obligations under these Terms to any company, firm, or person at any time. You may not transfer your rights or obligations under these Terms to anyone else. These Terms are personal to you and no third party is entitled to benefit under these Terms except as set out here.

Applicable Law

Your use of the Services is governed by these Terms and these Terms shall be construed and enforced in accordance with the laws of the State of California, United States. Disputes arising from or in connection with your use of the Services we provide are subject to the non-exclusive jurisdiction of the federal and state courts located in the county of San Francisco in the State of California.

We make no representations that the Services are appropriate or available for use outside of the United States. If you access the Services from any other jurisdiction you do so out of your own volition and you are responsible for compliance with the applicable laws.

No Waiver

If we delay exercising or fail to exercise or enforce any right available to us under these Terms, such delay or failure does not constitute a waiver of that right or any other rights under these Terms.

Force Majeure

We will not be liable to you for any lack of performance, or the unavailability or failure, of the Services, or for any failure or delay by us to comply with these Terms, where such lack, unavailability or failure arises from any cause beyond our reasonable control.

Written Communications

Applicable laws require that some of the information or communications we send to you should be in writing. When using the Services, you accept that communication with us will be mainly electronic (including via text message). We will contact you by email or by text message or provide you with information by posting notices on the Services. You agree to this electronic means of communication (including via text message) and you acknowledge that all contracts, notices, information, and other communications that we provide to you electronically (including via text message) comply with any legal requirement that such communications be in writing.

Severability

If any court or competent authority decides that any of the provisions of these Terms are invalid, unlawful, or unenforceable to any extent, the provision will, to that extent only, be severed from the remaining provisions, which will continue to be valid to the fullest extent permitted by law.

Entire Agreement

These Terms and any document expressly referred to in them constitute the whole agreement between us and supersede all previous discussions, correspondence, negotiations, previous arrangement, understanding or agreement between us relating to their subject matter. We each acknowledge that neither of us relies on, or will have any remedies in respect of, any representation or warranty (whether made innocently or negligently) that is not set out in these Terms or the documents referred to in them. Each of us agrees that our only liability in respect of those representations and warranties that are set out in this agreement (whether made innocently or negligently) will be for breach of contract. Nothing in this section limits or excludes any liability for fraud.

Third-Party Rights

Unless otherwise stated in these Terms, a person who is not a party to these Terms will not have any rights under or in connection with these Terms.

Export Restrictions

You acknowledge that the Platform and Services and any related products, information, documentation, software, technology, technical data, and any derivatives thereof, that GloballyHired makes available (collectively “Excluded Data”) are subject to the export control and sanctions laws and regulations of the United States and other countries that may prohibit or restrict access by certain persons or from certain countries or territories currently including, but not limited to, Cuba, Russia, Ukraine, Sudan, Iran, North Korea, and Syria (“Trade Restrictions”). You represent and warrant that you are not: (i) located in an embargoed country or territory, (ii) under the control of an entity organized in or a resident of an embargoed country or territory, (iii) listed on any U.S. government list of persons or entities with which U.S. persons are prohibited from transacting, including, but not limited to, OFAC’s List of Specially Designated Nationals and Other Blocked Persons, the U.S. State Department’s Nonproliferation Sanctions lists, the U.S. Commerce Department’s Entity List or Denied Persons List; or (iv) subject to end destination export control regulations, such as, but not limited to, the U.S. Export Administration Regulations and U.S. Government EU Dual-Use Regulation EC 428/2009. You are solely responsible for complying with Trade Restrictions for all Excluded Data and any of its content transmitted through the Services.

Copyright Infringement/DMCA

GloballyHired respects the intellectual property rights of others and requests that users of the Services do the same. If you believe that your work is being used in connection with the Platform or Services in a way that constitutes copyright infringement, you may notify us by providing our copyright agent with the following information in writing: (i) the electronic or physical signature of the owner of the copyright or the person authorized to act on the owner’s behalf; (ii) identification of the copyrighted work that you claim has been infringed; (iii) identification of the material that is claimed to be infringing and information reasonably sufficient to permit GloballyHired to locate the material (for example, by providing a URL to the material); (iv) your name, address, telephone number, and email address; (v) a statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; and (vi) a statement that the information in your notification is accurate and a statement, made under penalty of perjury, that you are the copyright owner or are authorized to act on the copyright owner’s behalf.

It is our policy to terminate, in appropriate circumstances, any account or user for repeated infringement of intellectual property rights, including copyrights, and we also reserve the right to terminate an account or user for even one instance of infringement.
